Establecimiento de tratados y normas

El reconocimiento internacional de los tratados entre las naciones indígenas y los Estados fue la primera cuestión que planteó el CITI a las Naciones Unidas. Se han logrado avances significativos a través del Estudio de los Tratados de las Naciones Unidas (1999) y la adopción de la Declaración de las Naciones Unidas sobre los Derechos de los Pueblos Indígenas (2007), junto con la Declaración Americana sobre los Derechos de los Pueblos Indígenas (2016). A lo largo del proceso de 40 años duración, el CITI fue líder en el desarrollo y la adopción de la Declaración de las Naciones Unidas, y continúa centrándose en su plena aplicación, incluso mediante el avance de nuevas normas internacionales que afirman e incorporan los derechos inherentes y los derivados de los tratados de los pueblos indígenas. El CITI sigue trabajando en pro del reconocimiento y la aplicación de los derechos de los tratados en materia de agua, salud, tierra, subsistencia, consentimiento y libre determinación, así como en favor de procesos bilaterales, regionales e internacionales eficaces para abordar y resolver las violaciones de los tratados.

Los tratados entre naciones soberanas implican explícitamente acuerdos que representan “la ley suprema de la tierra” y obligan a cada una de las partes a entrar en una relación internacional inviolable.

      Enhanced Participation of Indigenous Peoples

      On 8 September 2017 the General Assembly adopted resolution A/RES/71/321 entitled Enhancing the Participation of Indigenous Peoples’ Representatives and Institutions in Meetings of Relevant United Nations Bodies on Issues Affecting Them. This resolution is a result of a process that began with a commitment by Member States, during the World Conference on Indigenous Peoples in 2014, to consider the participation of indigenous peoples at the United Nations. The process continues based on decisions made by the General Assembly in resolution A/RES/71/321.
